These Terms of Service ("Terms") govern your access to and use of the products and services provided by Ethereal AI Media LLC ("Ethereal Media," "we," "us") under the brand Ethereal Media, including the Forge product line. The AI Visibility Audit (Forge Scan) is currently available; additional tiers are on the roadmap. By purchasing or using any of our services, you agree to these Terms.

1. Services

Ethereal Media provides AI-visibility scanning, agentic-web remediation artifacts, monitoring, and consulting services. Specific deliverables, scope, and timelines for each tier are described on our pricing page and in your order confirmation.

2. Accounts

To purchase any of our services you create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Payment

Payments are processed by Stripe. By providing payment information, you authorize us (via Stripe) to charge the amounts shown at checkout, including any applicable taxes. Where a service is offered on a recurring basis, the subscription renews automatically until cancelled from your portal; the offer confirmation at checkout will identify any recurring charges.

4. Refunds

Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference.

5. Acceptable Use

You may not use Forge products to scan websites you do not own or do not have permission to test. You may not resell, redistribute, or reverse-engineer the Forge artifacts, reports, or platform without a separate written agreement. You may not use our services to generate or distribute illegal, infringing, or harmful content.

6. Intellectual Property

We retain all rights, title, and interest in the Forge platform, scanning methodology, scoring framework, and underlying software. You retain rights to your own website, content, and data. The audit reports and any deliverables we generate for you under a paid order are licensed to you for use related to the site identified in your order.

7. Disclaimers and Limitation of Liability

Forge products are provided "as is." We make no guarantees about specific search-engine rankings, AI-citation outcomes, or business results. To the maximum extent permitted by law, Ethereal Media's total liability for any claim arising out of or relating to these Terms is limited to the amount you paid us in the twelve (12) months preceding the claim.

8. Termination

You may stop using our services at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a security risk. Sections that by their nature should survive termination (intellectual property, limitation of liability, governing law) will continue to apply.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida.

10. Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated to active customers by email.
